Statutory Declaration of Common-law Union

今日はRichmondの弁護士事務所まで行って「Statutory Declaration of Common-law Union」の宣誓をしてきました。

「Statutory Declaration of Common-law Union」とは、未婚のカップルでも結婚している夫婦と同等の法的権利を受けるために行う宣誓です。今回の宣誓は相方の移民申請に私をパートナーとして追加するために行いました。

事前にアプリケーションフォームに必要事項を記入してから弁護士事務所に行くように言われていたのですが、どう記入していいのか分からないところがあったため、そこは記入せずに持って行き、空欄は弁護士さんに埋めてもらいました。

Statutory Declaration of Common-law Unionの記入方法

1. My common-law partner and I :

a) Have jointly signed a residential lease, mortgage or purchase agreement relating to a residence in which we both live.

5. Solemn Declaration

今後、Common-lawであることを法的に主張したい際、この弁護士さんのサインが入ったStatutory Declaration of Common-law Unionのコピーを証明書として使うことができるのだそうです。移民局など政府機関が私たちをCommon-law Unionであるかどうか確かめたい場合、Commissioner of Oathsに連絡を取って「この二人はあなたのところでちゃんと宣誓したの？」と確かめるのだそうです。宣誓代金は$28.25（税込）でした。

ちなみに、もし二人が別れる場合はこの弁護士に再度会って、「私たち、別れます」と伝えてStatutory Declaration of Common-law Unionを無効（Declaration of severance of common-law relationship）にしなきゃいけないんだそうです。彼氏に「If we want to break up and don't go lawyer office, it's illegal. So, nothing easy to break up! Hahaha!（もし僕ら今後別れることになったら、弁護士に連絡しなきゃダメなんだって。簡単に別れられなくなっちゃったね。ははっ）」と、円満の笑顔で言われました。

Declarationの後、その足で同じビル内にある移民カウンセラーの事務所（以前のエントリの中国系D移民弁護士事務所（Richmond））に行き、相方（メイン申請者）＆私（サブ申請者）のSkilled Workerの移民申請代行を正式に申し込みました。

契約書を作り、申請代行代二人分$3,500から前金として$1,500をジョイントアカウントから小切手で支払いました。（残高は申請書類が出来上がって移民局に送付する前に支払うことになります）

・健康診断料　$200ぐらい（プロセスが進み、移民局から要請が来たら）
・国境でのLanding Fee　$490/person

うーん、お金かかるなあ。。
